The Hon’ble Division Bench of the High Court of Delhi presidedby the Chief Justice has passed a Judgment dated 24.04.2020 in W.P.(C)2993/2020 titled as “Naresh Kumar vs. Directorate of Education” wherein thePetitioner’s prayer seeking exemption from payment of Tuition Fees during theperiod of the Lockdown was rejected. The Hon’ble High Court further endorsedthe Judgment passed by the Ld. Single Judge in WP (C) 2977/2020 titled as“Rajat Vats v. GNCTD” wherein it was held that:

“7. Insofar as thetuition fee is concerned, the charging of the same would be justified in viewof the fact that almost all the schools are conducting online classes andteachers are discharging their functions by imparting course work over onlineplatforms, checking project work online, correcting papers wherein studentshave already given examinations, preparing questions and lessons taught andsupervising students to complete the work given etc. There is also a burden onthe schools to pay their staff during these months.

8. The authorities having taken cognisance of the issue and furtherthe matter being one in the policy domain, this Court is not inclined tointerfere.”

In view of the above direction passed by the Hon’ble HighCourt of Delhi we request you to remit the Tuition Fee from the month of April2020 and onwards which is due from you. The same is in the spirit of theJudgment of the Hon’ble High Court. It is also requested that the arrears ofFee due prior to the lockdown, be cleared at the earliest by cheque and/oronline payment to the school account.
